1. Introduction
Ken Herbert Plumbing, LLC (“Ken Herbert Plumbing,” “we,” “us,” or “our”) respects your privacy. 2.2 Information Collected Automatically
When you visit the Site, certain information is collected automatically through cookies, pixels, tags, and similar technologies, including your IP address, device and browser type, operating system, referring and exit pages, pages viewed, links clicked, approximate location derived from IP address, and dates and times of visits. See Section 5 for details on the specific technologies we use.
2.3 Information From Third Parties
We may receive information about you from service providers, advertising platforms, payment processors, financing partners, and lead sources that help us operate our business and reach customers.
2.4 Categories of Personal Information (for California residents)
For purposes of the California Consumer Privacy Act, in the past 12 months we have collected the following statutory categories: identifiers (name, address, email, phone, IP address); customer records (billing/payment information); commercial information (services purchased or requested); internet or network activity (browsing and interaction data); geolocation data (approximate, from IP address); and professional or employment information (if you apply for a job). We do not intentionally collect sensitive personal information beyond what is needed to process payments or provide services, and we do not use or disclose sensitive personal information for purposes that would require an opt-out under California law.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and provide estimates
- Schedule, perform, and follow up on plumbing, drain, heating, and cooling services
- Send appointment reminders, technician arrival updates, and service notifications (including by text message — see Section 6)
- Process payments and administer financing
- Manage maintenance agreements and warranties
- Operate, maintain, secure, and improve our Site
- Measure and improve our marketing and advertising
- Detect and prevent fraud, spam, and abuse
- Evaluate employment applications
- Comply with legal obligations and enforce our agreements
4. Cookies and Similar Technologies
We and our service providers use cookies, web beacons, pixels, and tags to run the Site, remember your preferences, measure traffic, and support advertising. You can control cookies through your browser settings; blocking some cookies may affect how the Site functions.
Where required by law, we honor recognized opt-out preference signals, including the Global Privacy Control (GPC), transmitted by your browser or device.
5. Analytics and Advertising
We work with third-party analytics and advertising providers that collect information about your use of the Site and your activity across other sites and apps over time. These include:
- Google (Google Analytics, Google Ads, and Google Tag Manager) — website analytics and advertising measurement. You can learn about Google’s practices and opt out of Google Analytics using Google’s browser add-on at tools.google.com/dlpage/gaoptout.
- Meta (Facebook) Pixel — advertising measurement and audience targeting on Meta platforms. You can adjust your ad preferences in your Facebook/Instagram account settings.
- Ad-verification and fraud-prevention providers — used to protect our advertising against invalid or fraudulent traffic.
- Other analytics, advertising, and lead-generation partners we may use from time to time.
“Sale” and “sharing” for targeted advertising. Some of this activity — such as the use of advertising cookies and pixels that share identifiers and browsing information with Google and Meta for cross-context behavioral advertising — may be considered a “sale” or “sharing” of personal information under California law and certain other state privacy laws, even though we do not receive money for it. You have the right to opt out of this activity. See Section 10 for how to exercise that right, and note that we honor the Global Privacy Control signal described in Section 4.
6. SMS Communications and Mobile Information
This section describes how we handle mobile phone numbers and text (SMS/MMS) messaging.
- Collection and consent. We may collect your mobile phone number and SMS messaging consent when you provide it to us verbally, in person, by phone, through a form on our Site, or through another approved opt-in method. Providing your number and consent is not a condition of purchasing any product or service.
- How we use it. We use this information to send service-related text messages, which may include appointment reminders, technician arrival (“on-the-way”) updates, service and dispatch updates, billing and payment notifications, and other communications related to services you request from us.
- Message frequency. Message frequency varies based on your interactions with us and the services you request.
- Rates. Message and data rates may apply, depending on your mobile carrier and plan.
- No sharing or sale of mobile data. We do not sell, rent, or share mobile phone numbers, SMS opt-in data, or SMS consent status with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties for marketing purposes, and are excluded from any other sharing described in this Policy. SMS consent information is used only to support our communications with you and to comply with applicable messaging requirements. We may share your number with a technology vendor (such as our messaging platform provider) strictly to deliver messages on our behalf.
- Opting out. You may opt out of SMS communications at any time by replying STOP to any text message from us. After you reply STOP, we may send one confirmation message acknowledging your opt-out.
- Help. You may request assistance at any time by replying HELP, or by contacting us at (513) 383-2974.
- Delivery. Carriers are not liable for delayed or undelivered messages.
7. Payment Processing
Payments are processed by third-party payment providers, including Stripe. When you make a payment, your card and payment details are collected and processed by the payment provider under its own terms and privacy policy. We do not store full payment card numbers on our own systems. Financing, when offered, is processed by third-party lending partners who collect and use your information under their own privacy policies.
8. How We Share Information
We share personal information only as described below. We do not sell your personal information for money. (Certain advertising-related “sales” or “sharing” as defined under state privacy law are addressed in Section 5, and your opt-out rights are described in Section 10.)
We may share information with:
- Service providers and vendors who perform services on our behalf — scheduling and dispatch, hosting, IT support, payment processing, messaging, analytics, advertising measurement, and similar functions — and who are contractually limited to using it for those purposes.
- Our affiliated company, Reading Heating & Air, where needed to provide combined or referred services you request.
- Financing and warranty partners when you apply for financing or register a product.
- Legal and safety recipients — to comply with law, respond to lawful requests, enforce our agreements, or protect the rights, property, or safety of our customers, our team, or the public.
- In a business transfer — if we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
As noted in Section 6, mobile opt-in and SMS consent data are never shared for third-party or affiliate marketing purposes.
9. Data Retention
We retain personal information for as long as needed to provide services, maintain your account and service history, comply with our legal, tax, accounting, and warranty obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the rights below. We extend the core rights described here to residents of all U.S. states, regardless of whether a specific state law technically applies to us.
You may have the right to:
- Know / Access — request confirmation of whether we process your personal information and obtain a copy of the personal information we hold about you.
- Correct — request correction of inaccurate personal information.
- Delete — request deletion of personal information we have collected from you, subject to legal exceptions (for example, information we must keep for warranty, tax, or recordkeeping reasons).
- Data portability — obtain a copy of certain information in a portable format.
- Opt out of targeted advertising and the “sale” or “sharing” of your personal information (see Section 5).
- Opt out of profiling in furtherance of certain decisions producing legal or similarly significant effects (we do not currently engage in such profiling).
- Non-discrimination — you will not receive discriminatory treatment for exercising your privacy rights.
California Residents (CCPA/CPRA)
California residents have the rights above, plus the right to know the categories of personal information collected, the sources, the business or commercial purposes for collecting it, and the categories of third parties with whom it is shared (all described in this Policy). California residents may also limit the use of sensitive personal information; we do not use or disclose sensitive personal information for purposes that trigger this right. You may designate an authorized agent to submit requests on your behalf. We will honor Global Privacy Control signals as a valid request to opt out of sale/sharing. Under California’s “Shine the Light” law, you may also request information about disclosures to third parties for their direct marketing purposes; we do not share personal information with third parties for their own direct marketing.
Indiana, Kentucky, and Other State Residents
Indiana (ICDPA) and Kentucky (KCDPA) residents, along with residents of other states with comprehensive privacy laws, may exercise the applicable rights listed above. If we deny your request, you may appeal by contacting us using the details in Section 14; we will respond to your appeal within the timeframe required by your state’s law. If your appeal is denied, Indiana and Kentucky residents may submit a complaint to their state Attorney General:
- Indiana Attorney General: www.in.gov/attorneygeneral
